and music production. By purchasing, downloading, installing or using our products, you agree to these Terms and our End User License Agreement (EULA).
These terms may be updated when necessary - the latest posted version always applies. If changes are made, we will indicate the "Last updated" date at the end of this document.

Refers to Marcos Ciscar Sampled Instruments, the provider of the virtual instruments and related services.

Refers to the single, non-exclusive, non-transferable, perpetual right granted to the User to use the Product according to these Terms and the EULA.

Fastspring (Merchant of Record / MoR)
Refers to the third-party service that handles payment processing, VAT, invoicing and order management on behalf of Marcos Ciscar Sampled Instruments.

Pulse Downloader
Refers to the software used to download certain products, ensuring delivery and proper installation of digital goods.

Native Instruments Kontakt
Refers to the software required to use certain products. Users are responsible for owning a compatible version of Kontakt, as specified for each Product.

2. Purchase Terms
Before purchasing, you are responsible for verifying that your version of Native Instruments
Kontakt and your operating system meet the product’s system requirements. No refunds are issued for purchases where incompatibility is due to unsupported software versions, outdated Kontakt versions or insufficient system performance.

2.1 Payments and Tax handling
All purchases initiated on our website are completed through Fastspring, which handles the shopping cart, payment processing and legal responsibilities. As our MoR, Fastspring handles VAT, sales tax, invoicing, compliance and receipts in accordance with the regulations in your region. We do not store or process your payment card details ourselves. By completing a purchase you also agree to Paddle’s terms and privacy policy.​

2.2 Prices and Currency
All prices in the checkout are displayed in the currency provided by Fastspring for your region. The final price includes any applicable VAT or taxes based on your location.
2.3 Refunds
Because our products are digital goods that cannot be returned, all sales are final.
You are responsible for ensuring that your system, operating system and version of Native
Instruments Kontakt meet the requirements for the purchased instrument before making a purchase.
We do not offer refunds for incompatibility due to unsupported software or hardware. We are not responsible if the content of the product does not meet your particular purposes.

2.4 Delivery
After completing your purchase at this website, you will receive a download link and/or product delivery. Some products are delivered using the Pulse Downloader. You are responsible for ensuring
that your system meets any technical requirements for the downloader to function properly.
2.5 Sales through Third-Party Stores
We only authorize sales of our instruments through the following verified distributors:

Any questions regarding purchases, billing, refunds, or license retrieval made through these platforms
must be handled directly with the respective store. Their terms and policies govern those purchases.
2.6 Unauthorized Downloads and Piracy
Copies of our products obtained outside the authorized platforms listed above and this website - including but not limited to unauthorized stores, file‑sharing sites, torrent sites, private groups or any other unverified distributor - are strictly prohibited. Unauthorized downloading, sharing or distributing of our products constitutes copyright infringement and may result in legal action, license cancellation and financial penalties. This applies to all products, including free products.
3. System Requirements and Compatibility
Our products typically require the full version of Native Instruments Kontakt, with the required version clearly stated on each product page.
Before purchasing, you are responsible for:

Verifying that you own a compatible Kontakt version.

Ensuring compatibility with your operating system and computer hardware (CPU, RAM, disk space).

Confirming any third‑party plugin or library requirements.
We do not offer refunds for issues caused by incompatibility. If you need help determining

4. End User License Agreement (EULA)
Our virtual instruments are licensed, not sold, and ownership is not transferred to you. When you
purchase one of our virtual instruments, you receive a single, non‑exclusive, non‑transferable,
perpetual license. One license is valid for one named user. This applies to all products, including free products. For multi-user, educational or enterprise use - additional or site licenses are required.

4.1 Permitted Use
You may use our virtual instruments in:

Sound design for film, games, theatre, advertisements and other creative projects.

Public performance and broadcast.
You may use the sounds freely in your creative output with no royalty obligations.
4.2 Prohibited Use
You may not:

Resell, share, rent, lend or distribute the product or its components in any form.

Use the samples to create competing sample libraries, virtual instruments or soundware.

Upload or share the products on any platform, public or private.

Upload the instruments, samples or audio demos to AI training datasets or platforms that enable model training without our explicit permission.

Share your license with other individuals or entities beyond what is permitted by your license.​​

5. Updates and Support
We may provide updates or improvements to products. Minor updates (bug fixes, small content
corrections) are provided free of charge. Major expansions or paid upgrades are sold separately. Update
conditions vary depending on the retailer from which the product was purchased.
We provide technical support for installation and activation of our products. Support does not extend to third-party DAW configuration or unsupported Kontakt versions.
6. Intellectual Property Rights
All instruments, samples, recordings, images, texts, names and other materials are the exclusive intellectual property of Marcos Ciscar Sampled Instruments. Purchasing a license does not grant you
ownership of these assets. This applies to all products, including free products.
6.1 Third-Party Licenses
Some products may include third‑party components (scripts). Such elements are used under
license, and any third‑party license terms apply. You may not extract third‑party samples for reuse
outside the product unless permitted by the third‑party license.
7. Disclaimer of Warranties
All products and website content are provided "as is" without warranties of any kind, either expressed
or implied. We do not guarantee compatibility with every system configuration, nor do we guarantee
uninterrupted or error‑free operation.

8. Limitations of Liability
To the maximum extent permitted by law, we are not liable for:

9. Changes to Products and Availability
We may discontinue or modify products, features or download methods at any time. We do not guarantee perpetual availability of specific downloads - you should keep backups of purchased content.
10. Termination
We may revoke your license and access to updates if you violate any part of this Agreement, including
unauthorized sharing, distribution or piracy.
11. Website Terms of Use
By accessing or using www.marcosciscar.com, you agree to use the Website in a lawful, respectful and
non‑disruptive manner. Any attempt to interfere with the Website’s functionality - including introducing
harmful code, bypassing security systems or disrupting services - is strictly prohibited.
All content on the Website - including images, audio demos, product descriptions, branding and
written material - is the property of Marcos Ciscar Sampled Instruments and may not be copied,
reproduced, altered or distributed without written permission.
We strive to keep the Website available and functioning smoothly but cannot guarantee uninterrupted
access. Maintenance, technical issues or external factors may occasionally affect availability.
The Website may contain links or integrations to third‑party platforms such as Fastspring, Pulse
Downloader, YouTube or social media services. These are provided for convenience only - we are not

Our Terms and EULA are governed by Swedish law, and any disputes shall fall under the exclusive jurisdiction of the Swedish courts.
However, purchase and payment transactions processed through Fastspring are handled separately by Fastspring.
